  • Welcome to The Rental Studio’s terms and conditions for Lender (“Terms and Conditions”). Please note that the websites lend.therentalstudio.com and www.therentalstudio.in (“Website” or “Platform”) are owned and operated by Aspirebels Private Limited (Company), a Company duly registered and incorporated under the Companies Act, 1956, whose registered address is B-11, Talwandi, Kota, Rajasthan, 324005, India.

  • By using the Website, you signify your agreement to the Terms and Conditions and our Privacy Policy. We advise you to read the Terms and Conditions carefully before proceeding to access this Website. If you do not agree to the Terms and Conditions, you should not use the Website or review information or have any transactions on the Website. The Company reserves the right to change, modify or remove content from the Website without prior notice, due to technical, regulatory, or business limitations or for any other reason. The Company may modify the Terms and Conditions at any time and at its sole discretion and such modifications shall be effective immediately upon posting of the modified policies, terms and conditions on the Website.

  • When we refer to "we", "our" or "The Rental Studio", we refer to Aspirebels Private Limited. When we refer to "you" or "your", we refer to you, the person who uses the lending Services through our Platform.

  • Definitions

  • Except when a different meaning occurs in the very context in which the word is used, whenever the following terms and expressions used with capital letters are used in the Terms and Conditions, regardless of whether they are used in the singular or plural, they will have the following meaning:

    • Article or Product: any good or product that is available to be rented through the Website.

    • Rental Agreement: the rental agreement concluded between Users, composed of the Terms and Conditions and the concrete conditions defined and presented by LENDER on the Platform associated with the specific Article, presented in your user profile or any conditions inherent in the rental that are not presented on the Platform.

    • RENTER: is a natural or legal person who rents through the Platform Articles made available by Users of the Platform, provided that this activity is not directly linked to their main commercial, industrial, artisanal or professional activity.

    • LENDER: a natural or legal person who uses our software to manage his rental operation and who may also provide goods to be rented by users of the Platform, as a commercial, industrial, artisanal or professional activity even if not exclusively or mainly.

    • Marketplace (“Service”): the website managed by The Rental Studio in the form of a website listing, available at https://lend.therentalstudio.com and/or https://www.therentalstudio.com

    • User: natural or legal person with full legal capacity to give or receive for rent the items listed on the Market Platform, in accordance with Indian law. VII. Cooling Off Period: refers to the period during which a RENTER can cancel a request to rent an item without incurring any charges. This period extends from the time of making the request until it is accepted by the LENDER or up to 48 hours before the estimated delivery date, whichever comes first. If the request is made within 48 hours of the start date, the cooling-off period is reduced to 1 hour after the request is submitted. During the cooling-off period, the RENTER is eligible to receive a full refund upon cancellation.

    • Order: refers to a RENTER'S request to rent one or more items from a specific LENDER on the Platform. An order is a comprehensive transaction that encompasses the selection and reservation of one or more products or services offered by a particular LENDER through the platform.

    • Substantial Size: refers to the physical dimensions and weight of items being rented that exceed the practical limits for easy manual transport or handling X. Rental Duration or Rental Period: refers to the duration of the Order. XI. Product Information: refers to a comprehensive set of details and specifications required by the Company to successfully list a product on its platform. This information encompasses various attributes, including but not limited to product condition, description, images, pricing, availability, and any specific criteria outlined by the Company.

    • Listing:refers to the detailed presentation of a product or item that a LENDER (individual or entity) makes available for rent through the Platform. XIII. Booking:is a transactional event that occurs when a RENTER expresses a formal intention to rent a listed item from a LENDER on the Platform. XIV. Total Price: Total Price refers to the complete cost associated with a booking on the Platform and is determined at the time the RENTER places an order. This cost encompasses all charges, fees, and any applicable taxes, and it may vary based on the specific payment plans offered to the RENTER, such as One Time or Per Month. The Total Price is the amount that the RENTER is required to pay to confirm and secure their booking on the platform. XV. One Time: A One Time payment refers to a single, upfront payment made by the user for a defined order or transaction. This payment covers the rental value for the specified order, but it does not necessarily imply that all future dues or obligations are paid. It is a one-time payment for the particular order in question, and any additional charges or payments related to future orders or extended services are typically handled separately.

    • Per Month: A Per Month payment is a recurring payment method in which the user pays the rental value on a monthly basis for the duration of a specified tenure. With this payment arrangement, the user is obligated to make monthly payments, each covering the rental value for one month, until the designated tenure is completed.

    • Payout: A Payout refers to the process of transferring funds or payments from the platform to a LENDER’S designated financial instrument or account.

    • Payout Method: A Payout Method is a designated financial instrument or account chosen by a user, typically a Host, on a P2P Rental Marketplace, through which they receive funds or payments for their provided services or listed items.

  • Product Listings

    • PRODUCT INFORMATION

    • You ("LENDER") will, in accordance with applicable Company policies, provide in the format we require the accurate and complete Product Information for each product that you make available to be listed for renting through the Website and promptly update such information as necessary to ensure it at all times remains accurate and complete. Each product must meet the requirements found here. You may only use the Services in connection with products that you own or otherwise have all the necessary rights and permissions to share for compensation. If the product you list on the Services is enabled with a device or OEM technology capable of determining location of the product, collecting telematics data, disabling technology, or image capturing you agree to comply with the requirements for tracking and technology devices and applicable law.

    • You shall not host, display, upload, modify, publish, transmit, update or share any information or image which:

    • Belongs to another person and over which you have no right;

      • Is grossly harmful, harassing, blasphemous, defamatory, bigotry, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever, or unlawfully threatening or harassing, including but not limited to ‘indecent representation of women’ within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
      • Is false, inaccurate or misleading in any way.
      • is patently offensive to the online community, such as sexually explicit content or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
      • harasses or advocates harassment of another person;
      • involves the transmission of ‘junk mail’, ‘chain letters’, unsolicited mass mailing, or ‘spamming’; including spamming by ways of unrelated feedbacks on surveys;
      • promotes illegal activity or conduct that is abusive, threatening, obscene, defamatory, or libelous;
      • infringes upon or violates any third party's rights [including but not limited to intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address, or phone number) or rights of publicity];
      • promotes an illegal or unauthorized copy of another person's copyrighted work such as providing pirated computer programs or links, information to
      • circumvent manufacturer-installed copy-protect devices, or pirated music or links to pirated music files;
      • contains restricted or password-only access pages, hidden pages or images or URLs leading to any other pages (those not linked to or from another accessible page);
      • provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
      • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses;
      • contains unauthorized videos, photographs or images of another person (whether a minor or an adult);
      • tries to gain unauthorized access or exceeds the scope of authorized access to the Platform, profiles, blogs, communities, account information, bulletins, friend requests, or other areas of the Platform, or solicits passwords or personal identifying information for commercial or unlawful purposes from other users on the Platform;
      • engages in commercial activities and / or sales such as contests, sweepstakes, barter, advertising, pyramid schemes, or the buying or selling of ‘virtual’ items related to the Platform without our prior written consent.
    • You acknowledge that by Listing an Article on the Website, you are representing that the Product is available for rental as described in your Listing. You agree that a legally binding agreement will be formed between you and the RENTER when the RENTER makes a Booking for your listed Item.

    • PRODUCT LABELING

    • LENDERS are prohibited from adding their own or their Company’s contact details on the products being lent out. This includes but is not limited to

      • LENDER Name
      • Contact Number
      • Email
      • Company Website
      • Personal or Company’s Social Media Handles
    • The Company reserves the right to remove this information if it is found on the products during the transaction period.

    • Kindly note: The Company shall not take any prior or post responsibility for compliances of applicable taxes levied on the LENDERS for the revenue received to them by virtue of this arrangement.

    • PRODUCT PACKAGING

      • It is the LENDER’S responsibility to package the products appropriately to ensure their safe transportation and storage during the lending period. LENDER also acknowledges that if the packaging provided by the LENDER is loose or in a condition that may not withstand normal wear and tear during usage, the LENDER may not receive the packaging back in its original state.

      • The LENDER agrees that the packaging and labeling of the product shall be for the sole purpose of protecting the product during transit and shall not be used for marketing purposes. LENDER shall not use any labels, flyers, or any other materials for the purpose of marketing the product.

      • Any damage, wear, or tear to the packaging, or any destruction caused due to inadequate packaging, is the sole responsibility of the LENDER. The Company or the RENTER shall not be liable for any packaging-related issues.

    • YOUR RESPONSIBILITIES

      • You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Services. You are responsible for setting your price. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Company platform except those expressly authorized by the Company. Do not encourage RENTERS to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Company Platform in violation of our Off-Platform Policy.
  • LENDER KYC

    • As a LENDER, you are required to complete your KYC (Know Your Customer) process before you can begin listing products on the Company platform. Your KYC process includes providing the following information and documents:

      • First Name
      • Last Name
      • Owner's ID Proof: OTP-based Aadhaar Card Verification
      • Email Verification
      • Current Picture of Owner
      • OTP-Based Mobile Verification
      • Shop Images
      • Company Website/Facebook/Instagram (Optional)
    • If you have a GSTIN (Goods and Services Tax Identification Number), you will additionally required to submit the following:

      • GSTIN Verification

      • Business Warehouse Address (can be multiple) with supporting proof ● Pan Card

      • Bank Account Details (name must match with GSTIN)

      • Canceled Cheque or Bank Passbook

    • If you do not have a GSTIN, you will additionally required to submit the following:

      • Business Document Verification: Partnership Deed/Certificate of Incorporation
      • Business Warehouse Address with supporting proof
      • Pan Card
      • Bank Account Details
      • Canceled Cheque or Bank Passbook
    • If you are a sole proprietorship, you will additionally seed to submit the Self Declaration document.

    • Completing your KYC process is a mandatory requirement to ensure the security and authenticity of listings on the Company's platform. Once your KYC is successfully completed, you will be eligible to list your products for rental.

  • Pricing Policy

    • The LENDER shall be required to set a price while making the Article available for listing on the website(s). There may also be variation in the price offered by you and the price listed on the website(s) as the price on website(s) may be including other relevant factors including but not limited to convenience fee, etc. The prices assigned will be the gross pricing and the Company will deduct a commission per transaction. Company reserves the right to adjust or revise the commission rates over time. This means that the percentage of the transaction value taken as commission may change periodically. LENDERS should be aware of this possibility and should check for any updates on the mail to the commission rates. Company will charge a commission fee for every successful transaction. The fees vary per product and may be revised from time to time with prior intimation to the users.

    • While LENDER can change the pricing of their Articles on any given time, the prices that are provided at the time of Order confirmation to the RENTER are what the pricing shall be until the completion of the tenure. Company reserves all right to take a call on this matter, and should there be any dispute, Company can cancel the contract, and the LENDER will have to take back the items at any point in time.

    • LENDERS can price their products under the plans listed below:

      • Daily Plan: LENDERS can add prices for product rentals for a duration of 1 day, 3 days, and so on, up to a maximum of 30 days. If they wish to offer products for longer durations exceeding 30 days, they should consider opting for the Monthly Plan.
      • LENDERS can allow only one type of payment option for RENTERS, which is the "One-Time" payment option. RENTERS will pay the entire rental fee upfront for the specified duration.
      • Monthly Plan: LENDERS can add prices for product rentals for a duration of 1 month and continue up to a maximum of 18 months.
    • LENDERS have the flexibility to offer both payment options:

      • One-Time: RENTERS can choose to pay the entire rental fee upfront for the entire duration of the rental period.
      • Per Month: RENTERS can subscribe to the rental plan, and charges will be deducted on a monthly basis, in accordance with the rental plan's terms.
    • Additionally, LENDERS can ask the RENTERS to pay:

      • Security Deposit: LENDERS have the option to require RENTERS to pay a security deposit when they rent certain products. A security deposit is a refundable amount that serves as a form of insurance against potential damage or misuse of the product.
      • Installation Charges: For products that require professional installation or setup, LENDERS can charge installation fees. This fee compensates for the cost and expertise involved in installing and configuring the product to ensure it functions correctly.
      • Delivery and Pickup Charges: When products need to be delivered to the RENTER’S location, LENDERS may impose delivery charges. These fees cover the cost of transportation, packaging, and handling. Delivery charges can vary based on factors such as distance, quantity and size of the product.
      • Additional Material Charges: In certain situations, LENDERS may need to use or provide specific materials or items as part of the Rental Agreement. For example, if the product being rented requires the use of copper wire, additional charges associated with these materials may apply. By notifying RENTERS in advance and being transparent about these charges, both parties can enter into the rental agreement with a clear understanding of the terms and costs involved.
    • LENDERS are allowed to react quickly to changing market conditions, special events, or short-term trends. For example, they might increase the price of a product during a peak demand period or offer discounts to boost sales during slow times.

  • Payment Policy

    • Payment Collection. Company collects the Total Price of a booking at the time RENTER places an order. The total price will vary based on the payment plans offered to the customer, i.e One Time and Per Month.

    • In case of Per Month payments, RENTER is subscribed to the rental plan and the rent is collected every subsequent month from the RENTER on the basis of the billing date of the Order.

    • Valid Payout Method. In order to receive a Payout you must have a valid Payout Method linked to your Company account. When you add a Payout Method to your Company account, you may be asked to provide information such as name, government identification, tax ID, billing address, and financial instrument information either to Company or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Company requires for a valid Payout Method may change, and Company Payments may request additional information at any time; failing to provide requested information may result in Company temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated. You authorize the Company to collect and store your Payout Method information. Company Payments may also share your information with governmental authorities as required by applicable law.

    • Timing of Payout

    • Subject to and conditional upon successful receipt of the payments from RENTER, Company will generally initiate Payouts to your selected Payout Method:

      • For Subscription Payments:In the case of subscription payments, the timing of Payouts will typically align with the subscription schedule established by the Company, which may recur at regular intervals, such as monthly, based on the subscription plan selected by the RENTER. However, for the initial payment of a subscription model, a specific payout arrangement is in place. The initial payment will be disbursed within 48 hours once the product is successfully delivered to the RENTER by the LENDER. Subsequently, the remainder of the subscription amount will be paid within 48 hours of the next recurring billing cycle based upon the chosen subscription plan. This approach ensures that you, as the recipient of the payment, receive your funds promptly for the first transaction while maintaining the recurring nature of the subscription payments in line with the selected plan.

      • For One-Time Payments: For one-time payments, the timing of Payouts is typically initiated within 48 hours after the Company successfully receives the full payment from the RENTER and it is delivered by the LENDER to the RENTER. This ensures that you, as the recipient of the payment, receive your funds in a timely manner once the transaction is complete. It's important to note that in the case of one-time payments, the Payouts may be structured as follows: 50% of the payment will be disbursed within 48 hours once the product is delivered to the RENTER, an additional 25% will be made available at the midpoint of the agreed upon rental tenure, and the remaining 25% will be released upon order completion. This phased approach to Payouts is designed to provide both the LENDER and the RENTER with assurance and aligns with the successful progression of the transaction.

    • Company may offer you a different Payout time or trigger for payment, which may be subject to additional terms and conditions. The time it takes to receive Payouts once released by the Company may depend upon the Payout Method you select.

    • Payout. Your Payout for a booking will be the Total Price less applicable fees like Company service fees and applicable taxes. In the event of cancellation of a confirmed booking, the Company will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.

    • Late Payment Charges.Company offers a buffer period of 4 days to the RENTERS from the billing date to clear the due amount. On the 5th day of delay, a late fee of 7% will be applied, and thereafter, an additional 1% will be added for each subsequent day of delay. The charges thus collected are remitted to the LENDER'S account upon successful receipt of payment. In the event of default beyond the 16th day, in accordance with the Company, LENDER has the right to visit and collect the items, with or without the consent of the RENTER and without prior intimation as well.

    • Payout Restrictions. Company may temporarily place a hold, suspend, or cancel any Payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity, or to obtain or verify requested information. Furthermore, the Company may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume Booking cancellations or modifications arising from a Force Majeure Event.

    • Limits on Payouts. For compliance or operational reasons, the Company may limit the amount of a Payout. If you are due an amount above that limit, the Company may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.

    • Payment Service Providers. Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Company is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use. Please review them before using your Payout Method.

    • Handling of Funds. Company may combine amounts that it collects from RENTERS and invest them as permitted under applicable laws. Company will retain any interest it earns on those investments.

    • Your Payout Method, Your Responsibility. Company is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.

    • LENDER hereby appoints Company as the LENDER’S payment collection agent solely for the limited purpose of accepting and processing funds from RENTER purchasing LENDER Services on the LENDER'S behalf.

    • LENDER also agrees that payment made by a RENTER through Company, shall be considered the same as a payment made directly to the LENDER, and the LENDER will provide the LENDER Service booked by the RENTER in the agreed upon manner as if the LENDER has received the payment directly from the RENTER. Each LENDER agrees that the Company may refund the RENTER in accordance with the Terms. Each LENDER understands that Company's obligation to pay the LENDER is subject to and conditional upon successful receipt of the associated payments from RENTER. Company guarantees payments to

    • LENDER(s) only for such amounts that have been successfully received by Company from RENTERS in accordance with these payments terms. In accepting appointment as the limited payment collection agent of the LENDER, Company assumes no liability for any acts or omissions of the LENDER.

  • Obligations

    • LENDER shall be responsible for keeping himself apprised and informed of the revised terms and conditions at all times.

    • LENDER acknowledges that there is risk in renting your items or services to others. While Company does its best to ensure a seamless and safe process, the transaction being entered into is between you (the LENDER) and the RENTER. LENDER recognizes that Company is not a party in this transaction and releases Company from all liability, claims, or damages that result from such interactions.

    • LENDER is responsible for all activities that occur in your account. You agree to notify us immediately of any unauthorized use of your account in order to enable us to take necessary corrective action. You also agree that you will not allow any third party to use your account for any purpose and that you will be liable for such unauthorized access.

    • LENDER agrees to leave reviews that provide accurate representation of their experience with the RENTER. Misinformation, misrepresentation, or defamatory language may be cause for removal from the Platform and could potentially lead to legal action.

    • You ("LENDER") are also responsible for ensuring that:

      • you provide accurate and detailed descriptions of all the items, including dimensions, materials, colors, brand, model and any unique features.
      • items are clean, free of stains, odors
      • all items are stable and safe to use.
      • there are no sharp edges or protruding parts that could pose a safety hazard.
      • you provide clear instructions and all necessary tools if the items can be disassembled
      • Any moving parts, such as drawers, hinges, or reclining mechanisms, should function properly.
      • you upload high-quality photos that accurately represent the item's current condition, including any existing wear and tear.
      • document any damages or changes in condition before and after the rental period with photos.
      • you remove personal decorations or items before renting.
      • you properly package the item to prevent damage during transportation.
      • you include all necessary accessories and components, such as remote controls.
      • specifying any special requirements or compatibility, such as voltage, plug type, or connectivity.
      • you provide service and maintenance throughout the tenure, if the Booking offered service and maintenance
      • you back up and lock your personal data on any electronic devices. The Company will not be responsible for any data loss.
      • you test the items before listing it to ensure proper functionality.
      • you deliver any RENTER items to the RENTER in accordance with the ORDER you have with the RENTER;
      • you will accept or reject the Order within 48 hours
      • Other than what is required for you to verify a RENTER'S KYC, you will not collect any information or documentation from your RENTER at the time of delivery
      • you ensure mattresses are clean, hygienic, and free from bed bugs.
      • in the event of an item swap, you will not require a RENTER to accept a higher priced item or force an unwanted item upgrade.
      • You will not cancel a booking for the purpose of seeking a higher price from a RENTER
      • you will honor all representations made in your listings, including honoring the price quoted to a RENTER
      • you do not list any items prohibited
      • If your item is subject to a lease, loan, or other financing agreement, you must confirm sharing your item on Company does not violate the terms of the contract with the lienholder.
      • You will not offer any item that is the subject of a missing or stolen item report.
      • you share the photos of the item delivered to the RENTER at the time of delivery
  • Delivery Policy

    • Company is only providing a platform for the communication between Users and does not provide any pick-up and delivery services with respect to the Orders placed by RENTERS on the Platform. Delivery of an Order placed on the Company platform would be undertaken directly by you, the LENDER.

    • LENDER will take the utmost care to package the rented items securely to prevent damage during transportation and will deliver the rented item(s) exclusively to the location specified during the booking process. LENDERS will not entertain any address change requests from RENTER without prior intimation to the Company. In some cases, the RENTER may not be present at the specified location during the initial delivery attempt. In such instances, the LENDER will be required to make a second delivery attempt to fulfill the rental agreement. Appropriate charges will be levied to the RENTER in cases where a second delivery attempt is necessary due to their absence. These charges are intended to cover the additional logistics and efforts involved in the second delivery. The charges will be clearly communicated to the RENTER, and upon successful receipt of payment, they will be transferred to the LENDER.

    • The LENDER is obligated to adhere to the specified delivery date and is required to communicate with the RENTER beforehand to coordinate a mutually convenient delivery time. If the LENDER delivers the item prior to the scheduled delivery date, the Rental Period will commence only from the specified delivery date and no extra amount would be paid to the LENDER for that. However, if the LENDER delivers the item after the scheduled delivery date, they will not receive payment for the delayed days, and this may potentially impact their reviews and ratings.

    • As part of our pricing policy, LENDERS will have three distinct delivery pricing options to choose from:

      • Custom Pricing: LENDERS are granted the flexibility to establish their own pricing for lending items. The pricing may vary based on factors such as distance, quantity of items, or any other relevant considerations. LENDERS are encouraged to communicate their pricing clearly to borrowers.

        • Example 1: A LENDER decides to offer rentals in the quantity range of 1 to 5 items with a short-distance delivery of less than 5km. For this combination, the LENDER sets a price of Rs 50. So, if a RENTER requests 3 items for delivery within 3 km, the total delivery and pickup charges would be Rs 50.

        • Example 2: In a similar vein, a LENDER selects a quantity range of 6 to 10 items with a short-distance delivery range of 0 km to 2km. They establish a price of Rs 199. So, if a RENTER requests 2 items and the delivery location is within 1km, the total delivery and pickup charges would be Rs 199.

      • Two-Wheeler Pricing: Under this pricing option, LENDERS shall determine their lending price by multiplying the price obtained from third-party delivery services (e.g., Borzo, Dunzo, or any other designated service) through the API by a factor of 2 at the time of delivery. This pricing option is suitable for two-wheeler delivery.

      • Three/Four-Wheeler Pricing: For lending transactions involving three or four-wheelers, LENDERS will calculate the lending price by multiplying the price fetched from third-party delivery services (e.g., Porter or any other designated service) through the API by a factor of 2 at the time of deliver

      • Free Delivery: LENDERS have the option to offer Free Delivery to borrowers by setting the delivery charges to 0. This can serve as an attractive incentive for borrowers seeking cost-free delivery services.

    • To protect the privacy and security of our RENTERS, when an order is created by the RENTER, LENDERS are provided with masked information about the RENTER. The unmasked details of the RENTER, including the full address, name, and phone number, will be shared with the LENDER one day prior to the scheduled delivery. This allows the LENDER to have a direct conversation with the RENTER about the delivery, ensuring both parties can coordinate and agree on a suitable delivery time.

    • No payments will be collected by the LENDER at the time of delivery or at any point during the rental period without prior acceptance from the Company. To enhance security and trust within our community, LENDERS will have the option to request KYC (Know Your Customer) documents from the RENTER at the time of delivery.

    • QUALITY CHECKS BEFORE DELIVERY

      • Before delivery, LENDERS are requested to conduct thorough quality checks on the rented items to ensure a smooth and satisfactory experience for the RENTER. LENDERS should verify that the rented items are in proper working condition and fully functional, as described in the product listing. The rented items should be clean and well-maintained. Any dirt, dust, or residue should be removed to present the items in their best possible condition. If, during the quality check, the LENDER identifies any issues, defects, or discrepancies with the items, it is imperative to bring these concerns to the notice of the Company immediately. We highly value the quality and condition of the items on our platform, and your cooperation in conducting these pre-delivery quality checks is essential in maintaining the trust and satisfaction of our RENTERS.

      • On the day of delivery, when the item is handed over to the RENTER, the LENDER is obliged to click a clear and time stamped photograph of the item. This photograph serves as proof of the item's condition at the time of delivery. The LENDER is required to upload this photograph to the Company's platform as part of the delivery confirmation process. It is essential to attach the image to the rental transaction to document the condition of the item when it was delivered. Please note that failure to fulfill this request may result in the Company or the RENTER not being obliged to entertain any damage claims or disputes related to the item's condition at a later date. Uploading the image provides transparency and a clear record of the item's condition, protecting both LENDERS and RENTERS in the event of any issues.

  • Damage Policy

    • Before renting out your product, it is essential to thoroughly inspect it and document its condition. Take clear photographs of the item from all angles, highlighting any existing flaws, scratches, or imperfections. This will serve as a reference point in case of disputes.

    • If a LENDER receives their item back in a damaged or significantly altered condition, they must report the issue to the Company at the time of pickup and must also inform the RENTER about the damages. This report should include photographs and a detailed description of the damage. You are required to report

    • that damage as soon as you become aware of it (and in any event, no more than 24 hours after the scheduled end of the rental period) and to provide reasonable cooperation in the investigation of the damage. If Company is not given prompt notice as described in this paragraph, or if you do not provide reasonable cooperation in the investigation by Company, we may not be able to determine the cause. In that case, you agree that we may decline any reimbursement for such damage.

    • This policy does not apply to the following:

      • Damages related/ due to normal wear and tear/ maintenance of the Article:

        • Any costs incurred by the LENDER in replacing any parts or repairing any damages during regular maintenance/servicing of the product or such damage/replacement is a result of normal wear and tear of the product.
        • Minor scratches (below 4 mm in width and depth and 4 cm in length) on wooden furniture would have to be ignored by the LENDER as they are considered normal wear and tear.
        • Minor Chips and breakages in timber (below 9mm in width 2mm in depth and 3 cm in length) would have to be ignored by the LENDER.
        • Normal wear and tear of less than 1 cm for the Entertainment category would have to be ignored by the LENDER.
      • Permanent Exclusions:

        • The LENDER understands and agrees that RENTER shall not be liable to compensate LENDER in any manner whatsoever under this Damage Policy if:

          • Any loss or damage is caused to the Article as a result of war, terror attacks, hostilities;

          • Any loss or damage is caused to the Article whose year of manufacturing is 8 years and above;

          • Wilful damages are caused to the Articles by the LENDER;

          • Any consequential losses to the Vehicle which are in possession of Hosts including but not limited to any loss resulting from:

            • short circuit, self-heating, electrical arcing or leakage due to any cause apart from the accident /fault of the RENTER
            • Electrical or mechanical breakdown due to operation in flooded areas not arising from the usage of RENTER.
            • Any damage arising due to normal wear and tear in the due course of usage of the Article and/or arising out of any manufacturing defects present in the said Article
      • Third Party Liability:

        • Any injury/damages to a third party are not covered under this policy. For the same, the LENDER is expected to maintain a comprehensive third-party insurance for the Article being listed on the Platform. Any claims for the same will not be accepted by the Company.

        • Any damages or issues not explicitly defined as 'normal wear and tear' in this agreement will be assessed and determined at the sole discretion of the LENDER after consulting with Company. Company's decision regarding such matters shall be final and binding. LENDERS hereby agrees that the Company at its sole discretion shall decide which product falls into which category.

        • Once a damage report is filed, the Company will initiate an assessment process. This may involve reviewing the pre-rental photographs, communicating with both the LENDER and RENTER, and seeking additional information as necessary. The Company is committed to making fair and impartial assessments. If it is determined that the item was damaged during the rental period and the RENTER is responsible, the LENDER will be eligible for compensation.

        • The LENDER after consulting with the Company shall have the authority to decide on the extent of damage caused to the Article. Company in accordance with the LENDER shall assess the cost and compensation to remedy the damage (“Damages”). The Company will determine the appropriate compensation amount, which may include repair costs or replacement value. Any damage amount will be first adjusted from the security deposit. In case, the damage exceeds the security deposit, then the amount is recoverable at the current Market Price.

        • Rental for such products will continue till full payment towards such compensation is received by the Company. Company or LENDER reserves the right to not return the RENTER'S Security Deposit at the time of Product return if any Product impairment is suspected. Any damage that results in the replaceable part of the product being unusable shall result in the value of the part being charged to the RENTER.

        • You also acknowledge that any damage which is a result of raw material or manufacturing defects will not be chargeable to the RENTER.

        • For any damage that leads to a loss of function of the Article that is repairable, the LENDER shall recover the actual cost of repair. LENDER and RENTER agree to be bound, legally and otherwise, by the report of LENDER’S chosen repair venue as to the cause and repair cost of the damage to the Article. LENDER shall be entitled to recover any additional costs it incurs in terms of transportation, consultation fee etc with reasonable market value terms while keeping in loop the Company.

      • Missing items

        • If your Article goes missing, is not returned, and/or is stolen during the rental period (or extension period), you, as the LENDER, must immediately contact a Company representative and follow his or her instructions, including cooperating with Company, the police, and any other authorities in all related to the investigation of the theft. If you are instructed by Company to file a police report, you must do so within 24 hours of receiving those instructions.
    • In the event of a dispute regarding damage or compensation, the LENDER have the option to escalate the matter to the Company. Company will review the evidence and mediate a satisfactory resolution.

  • Maintenance Policy

    • LENDERS on the Platform have the option to offer service and maintenance for their listed products. This offering is not mandatory, and LENDERS can choose to provide this service at their discretion.

    • LENDERS are not obligated to provide service and maintenance if the issue arises from the misuse or negligence of the RENTER, including but not limited to accidents, improper handling, or failure to follow product instructions. The Company reserves the right to decide the type of issue and the decision made by the Company shall be binding.

    • If LENDER has offered service and maintenance for the listed products, all service and maintenance needs will be taken by the LENDER and the following clauses apply;

      • The LENDER will be informed about any service or maintenance required by the particular RENTER by Company team and any RENTER who gets directly in touch with LENDER and is a Company customer should be redirected to Company team where a ticket can be maintained for the same.
      • LENDER will be informed to provide any service or maintenance required by the RENTER by Company team and the LENDER needs to give a confirmation of the ticket and needs to inform about undertaking that particular service request within 48 hours. In case of non-confirmation in 48 hours, Company will get the service or maintenance done by a third party and charges for the same will be borne by “LENDER”.
    • Upon accepting the service or maintenance request the LENDER will have 36 hours to fulfill the same.

    • In case of vendor accepting a certain service or maintenance request and fails to fulfill it in 72 hours or withdraws the acceptance from the time of agreeing and these 72 hours, the vendor will be liable to pay a penalty of 5% of Total Price to Company and also will be liable to pay the maintenance charges incurred by Company for the same through third party.

    • For any maintenance or service request a scenario where in any physical parts of the rented item needs to be replaced, the same process stated above in point will be followed.

      • Damages or losses caused by RENTER misuse or neglect will be fully recoverable from the RENTER. In case of willful damage by the RENTER, LENDER reserves the right to charge for the cost of repair or replacement. If the product is damaged beyond repair then the RENTER is liable to pay the full cost of the asset. Refer to the damage policy.

      • While LENDER can change the offerings of their Articles on any given time, the offerings that are provided at the time of Order confirmation to the RENTER are what the offerings shall be until the completion of the tenure.

      • For example: If LENDER is providing service and maintenance on refrigerator and RENTER has confirmed the Order, LENDER is obligated to provide service and maintenance to the RENTER at any point of time during the Rental Duration. If LENDER removes the service and maintenance from the Article, LENDER will still be obligated to provide service and maintenance to previously confirmed Orders before the said changes.

  • Early Termination Policy

    • The contract has a lock-in period that is equivalent to the tenure of the contract that is agreed by the RENTER in the contract at the time of ordering.

    • One-time Payment

      • When a RENTER'S mode of payment is one-time, the LENDER reserves the right to refund the amount for the unused tenure at its sole discretion.
    • Per-month payment

      • In the case of early termination, the RENTER can request to close the Order by informing the Company at least 2 weeks prior to the selected closure date. The Company will intimate the same to the LENDER as soon as it becomes aware of it.

      • For subscription-based payment models, the early termination charges are calculated based on the minimum Rental Duration, which is the least number of months the LENDER is offering a product. The charges will be listed on the product page.

      • The difference in monthly rental rates between the Contract Tenure (the tenure selected at order placement) and the Actual Tenure (effective tenure at early closure) will have to be paid.

    • The amount due will be calculated as follows:

      • (Actual Tenure Rent – Contract Tenure Rent) * Number of Months of Actual Tenure - transaction fee(if any) - commission(if any).

      • Example 1: Suppose a RENTER terminates their order after 7 months. The contract tenure rent is Rs 359 (9 months) but the actual tenure rate is Rs 389 (6 months)

      • Early closure charges: (389-359)* 7= Rs 210 - transaction fee(if any) - commission(if any)

      • Example 2: Suppose a RENTER terminates their order after 1 month. The contract tenure rent is Rs 1019 (12 months) but the actual tenure rate is Rs 1419 (3 months, i.e. the minimum rental duration of that particular product)

      • Early closure charges: (1419-1019)1 + 14192 = Rs 3238 - transaction fee(if any) - commission(if any)

      • Example 3: Suppose a RENTER terminates their order after 3 months. The contract tenure is Rs 499 (9 months) and the actual tenure rate is Rs 499(9 months, i.e. the minimum rental duration of that particular product)

      • Early closure charges: (499*6) = Rs 2994 - transaction fee(if any) - commission(if any)

      • The transaction and commission fees are then reduced from the early closure charges and transferred to the LENDER.

    • Note: All offers and discounts given to the RENTER shall be void in case of early termination or part return of items before the agreed-upon minimum rental duration.

  • Cancellation and Refund Policy

    • A RENTERS may cancel their Order through our website, and the cancellation is effective immediately. Whether the RENTER receives a full refund, a partial refund, or receives no refund depends on the circumstances. The total amount refunded will depend on when the RENTER cancels the order or suborder, length of the tenure and the payment mode. The LENDER acknowledges that the refund will be processed to the RENTER in accordance with the cancellation and refund policy as specified and following consultation with the Company.

    • FULL REFUND: COOLING OFF PERIOD AND CANCELLATION BEFORE ORDER CONFIRMATION

    • A RENTER retains the option to cancel a request to rent an item up to 48 hours prior to the estimated delivery date, a time frame commonly referred to as the 'cooling-off period.' However, if the Order is placed within 48 hours of the rental's scheduled commencement, the cooling-off period is shortened to just 1 hour after the Order has been placed. In cases where the RENTER chooses to cancel their request either before it has been accepted by the LENDER or during the cooling

    • off period, it is imperative for the LENDER to provide a full refund to the RENTER. PARTIAL REFUND: CANCELLATION OUTSIDE THE COOLING OFF PERIOD

    • If a RENTER wants to cancel an Order, they will notify the LENDER via Company messaging as soon as possible and to process the cancellation themselves through the website. The LENDER would issue a partial refund to RENTERS who cancel in this manner and do not fall within the free cooling off period.

    • Per-month

      • For monthly transactions, the LENDER may charge the RENTER up to 50% of the rental amount, subject to approval from the Company. This charge will range from a minimum of Rs 100 to a maximum of Rs 5000. Additionally, transaction fees, if applicable, will be the responsibility of the RENTER. The remaining portion of the rental amount will be refunded to the RENTER. The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 2000 per month for 3 months, the fee charged to RENTER would be Rs 1000 + transaction fee (if any). LENDER will deduct Rs 1000 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 15%, the Company would get Rs 150 as their commission. You would receive Rs 850 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rent an item with a value of Rs 2000 per month for 3 months, the fee charged to RENTER would be Rs 1000 + transaction fee(if any). Company will deduct Rs 1000 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 15%, the Company would get Rs 150 as their commission. You would receive Rs 850 as the LENDER.

    • One-time

      • If the Rental Period is no more than 15 days, the LENDER may charge the RENTER up to 10% of the rental amount paid, subject to approval from the Company. From a minimum of Rs. 100 to a maximum of Rs. 1000. In addition to these fees, transaction fees may apply which will be borne by the RENTER. Rest of the amount will be refunded to the RENTER. The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 3000 for 15 days, the fee charged to RENTER would be Rs 300 + transaction fee(if any). LENDER will deduct Rs 300 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 30 as their commission. You would receive Rs 270 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 3000 for 15 days, the fee charged to RENTER would be Rs 300 + transaction fee(if any). Company will deduct Rs 300 and refund the amount to the RENTER. Assuming the agreed-upon

      • commission rate is 10%, the Company would get Rs 30 as their commission. You would receive Rs 270 as the LENDER.

      • If the Rental Period is more than 15 days but no more than 30 days, the LENDER may charge the RENTER up to 10% of the rental amount paid, subject to approval from the Company. From a minimum of Rs. 250 to a maximum of Rs. 2500. In addition to these fees, transaction fees may apply which will be borne by the RENTER. Rest of the amount will be refunded to the RENTER.The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 4000 for 25 days, the fee charged to RENTER would be Rs 400 + transaction fee(if any). LENDER will deduct Rs 400 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 40 as their commission. You would receive Rs 360 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 4000 for 25 days, the fee charged to RENTER would be Rs 400 + transaction fee(if any). Company will deduct Rs 400 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 40 as their commission. You would receive Rs 360 as the LENDER.

      • If the Rental Period is more than 30 days, the LENDER may charge the RENTER up to 10% of the rental amount paid, subject to approval from the Company. From a minimum of Rs. 500 to a maximum of Rs. 5000. In addition to these fees, transaction fees may apply which will be borne by the RENTER. Rest of the amount will be refunded to the RENTER.The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 8000 for 6 months, the fee charged to RENTER would be Rs 800 + transaction fee(if any). LENDER will deduct Rs 800 and refund the amount to the Company which will be transferred

      • back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 80 as their commission. You would receive Rs 720 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 8000 for 6 months, the fee charged to RENTER would be Rs 800 + transaction fee(if any). Company will deduct Rs 800 and refund the amount to the RENTER. Assuming the agreed upon commission rate is 10%, the Company would get Rs 80 as their commission. You would receive Rs 720 as the LENDER.

      • PARTIAL REFUND: CANCELLATION ON THE ESTIMATED DELIVERY DATE

        • If a RENTER wants to cancel an Order, they will notify the LENDER via Company messaging as soon as possible and to process the cancellation themselves through the website. The LENDER will issue a partial refund to RENTERS who cancel in this manner and do not fall within the free cooling off period.
    • Per-month

      • For monthly transactions, the entire rental amount for the first month will be billed to the RENTER, along with a potential penalty of up to Rs 5000, at the discretion of the LENDER or Company. In addition to these fees, transaction fees may apply which will be borne by the RENTER. The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 1500 per month for 6 months, the fee charged to RENTER would be Rs 1500 + transaction fee(if any) + Penalty(if any). LENDER will deduct Rs 1500 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 150 as their commission. You would receive Rs 1350 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 1500 per month for 6 months, the fee charged to RENTER would be Rs 1500 + transaction fee(if any)+ Penalty(if any). Company will deduct Rs 1500 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 150 as their commission. You would receive Rs 1350 as the LENDER.

    • One-time

      • If the Rental Period is 15 days or less, the RENTER will incur a charge equal to 50% of the paid rental amount, with the possibility of a Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges which will be borne by the RENTER. Any remaining balance will be refunded to the RENTER. The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 5000 for 10 days, the fee charged to RENTER would be Rs 2500 + transaction fee(if any) + Penalty(if any). LENDER will deduct Rs 2500 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 250 as their commission. You would receive Rs 2250 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 5000 for 10 days, the fee charged to RENTER would be Rs 2500 + transaction fee(if any)+ Penalty(if any). Company will deduct Rs 2500 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 250 as their commission. You would receive Rs 2250 as the LENDER.

      • If the Rental Period is more than 15 days but no more than 30 days, the RENTER will incur a charge equal to 40% of the paid rental amount, with the possibility of a Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges which will be borne by the RENTER. Any remaining balance will be refunded to the RENTER.The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 8000 for 25 days, the fee charged to RENTER would be Rs 3200 + transaction fee(if any) + Penalty(if any). LENDER will deduct Rs 3200 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 320 as their commission. You would receive Rs 2880 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 8000 for 25 days, the fee charged to RENTER would be Rs 3200 + transaction fee(if any)+ Penalty(if any). Company will deduct Rs 3200 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 320 as their commission. You would receive Rs 2880 as the LENDER.

      • If the Rental Period is more than 30 days, the RENTER will incur a charge equal to 20% of the paid rental amount, with the possibility of a Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges which will be borne by the RENTER. Any remaining balance will be refunded to the RENTER. The Company will deduct its commission from the portion allocated to the LENDER based on the agreed-upon rate.

      • Assuming the order amount is processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 10000 for 3 months, the fee charged to RENTER would be Rs 2000 + transaction fee(if any) + Penalty(if any). LENDER will deduct Rs 2000 and refund the amount to the Company which will be transferred back to the RENTER. LENDER is also bound to refund the commission fees to the Company. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 200 as their commission. You would receive Rs 1800 as the LENDER.

      • Assuming the order amount is not processed to the LENDER

      • For example, if the RENTER rents an item with a value of Rs 10000 for 3 months, the fee charged to RENTER would be Rs 2000 + transaction fee(if any)+ Penalty(if any). Company will deduct Rs 2000 and refund the amount to the RENTER. Assuming the agreed-upon commission rate is 10%, the Company would get Rs 200 as their commission. You would receive Rs 1800 as the LENDER.

    • CANCELLATION DUE TO ANY OTHER REASONS

      • Cancellation Due To Order Rejection by LENDER

        • If a LENDER needs to cancel a Order, the Company requires them to provide a valid reason for the cancellation. The LENDER should also be aware that frequent cancellations may result in a negative impact on their rating within the platform. LENDERS also acknowledge that, in addition to potential impacts on their rating, they can be subject to penalties imposed by the Company for frequent or unjustified cancellations. The specific nature of these penalties will be outlined in the terms and conditions of the Company platform and may include financial penalties, restrictions on listing items for rent, or temporary suspension from the platform, among other measures.

        • Cancellation Due To Bad condition or not as specified

        • LENDERS understand that it is their responsibility to ensure that the item they list matches the provided item description accurately. Any discrepancies in the condition or specifications of the item that do not align with the listing may lead to cancellations by the RENTER upon inspection at the doorstep. In such cases, the Company is not liable to reimburse the LENDER for any costs they may have incurred.

        • With the photographic evidence provided, the Company, at its sole discretion, will assess the situation to determine whether the suborder should be canceled or not. The Company will review the evidence to evaluate the extent of the discrepancies between the listed item and the item received by the RENTER. Based on this assessment, the Company will make a final decision regarding the suborder.

        • It's important for all parties involved to understand that the Company's decision in this matter will be final and binding. The Company's objective is to ensure fairness and satisfaction for both RENTERS and LENDERS while upholding the platform's policies and standards.

      • Cancellation by The Rental Studio

        • Company also reserves the right to cancel the LENDER’S order at any time without prior information. In such cases, if the Order value has already been processed and transferred to the LENDER, the LENDER acknowledges that they are liable to refund the entire Order value in full to the Company. This refund should be made promptly in accordance with the Company's policies.

        • The Rental Studio reserves the right to prohibit, exclude or penalize any Users who incur successive cancellations, withdrawals or non-show.

        • If the RENTER fails to appear at the location at the second delivery attempt, The Rental Studio retains the right to cancel the order and may or may not issue a partial refund of the rental amount at its sole discretion. In such cases, LENDER will get the amount based on applicable terms of cancellation on the estimated delivery date.

  • Replacement Policy

    • If LENDERS are offering service and maintenance on their listed articles, the LENDER shall carry out the maintenance/repair of the Article within 2-3 working days after the request has been raised by the RENTER. However, in case of any national holidays, the RENTER needs to be considerate in case of delays due to national holidays.

    • In the event that the issue is not resolved during repair, the LENDER shall provide a replacement for the Article. If a replacement is not available, the Suborder will be terminated early, and the amount for that Suborder will be fully refunded to the RENTER. Refer to Early Termination Policy

  • Rating Policy

    • Company implements a system for sorting Articles and LENDERS that it understands to be essential to promote the success and quality of transactions, benefiting all stakeholders in our ecosystem, answering the User for the content of the opinion they decide to share.

    • After completing a transaction, Users can leave a public review (“Review”) and submit a star rating (“Rating”) about each other. Ratings and Reviews are not

    • verified by the Company for accuracy and may be incorrect or misleading. Ratings or Reviews reflect the opinions of individual customers and do not reflect the opinion of the Company.

    • The ratings and comments will be visible to all Users of the Platform and the content must be in line with the law, and must not contain, in particular:

      • obscene and pornographic content, insults, nor language that in any way encourages hate speech, racism or xenophobia;
      • Site addresses or hyperlinks to third-party sites;
      • personal data of third parties, namely, surname, name, address, telephone number or e-mail address, bank account number;
      • material that violates the rights of third parties, namely intellectual property rights,
      • material that is likely to offend the good name and reputation of third parties, as well as the prestige and credit of any trademarks or commercial establishments;
      • content that is false, misleading, inaccurate or that constitutes an act of unfair competitions
    • Company reserves the right to disregard and not publish the evaluation assigned in the average rating of the User or exclude the opinion in whole or in part when the evaluation or opinion:

      • is assigned by the User himself;

      • be aware of the existence of an agreement established between Users to influence the evaluations;

      • is assigned by the User's employees or family members;

      • has been assigned based on the resource in Users created with temporary emails;

      • is in manifest violation of these Terms or the applicable law. 6. discloses any personal information of another User;

      • Users are prohibited from manipulating the Ratings and Reviews system in any manner, such as instructing a third party to write a positive or negative Review about another User.

      • Ratings and Reviews are part of a Company user's public profile and may also be surfaced elsewhere on Company listings or bookings, number of cancellations, average response time and other information.

  • Indemnification

    • To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold Company harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of the

    • Terms and Conditions (including any supplemental or additional terms that apply to a product or feature) or our Legal Terms, (ii) your improper use of the Company Platform, (iii) your interaction with any User, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights , (vi) your Listings or Bookings and any consequences thereof.

  • Inspection

    • You after approval from the Company or the Company directly retains the right to inspect the Article delivered to the RENTER during the term of the Agreement.
  • Early Termination

    • The contract has a lock-in period that is equivalent to the tenure of the contract that is agreed by the RENTER in the contract at the time of ordering.

    • One-time Payment

      • When a RENTER'S mode of payment is one-time, the LENDER reserves the right to refund the amount for the unused tenure at its sole discretion.
    • Per-month payment

      • In the case of early termination, the RENTER can request to close the Order by informing the Company at least 2 weeks prior to the selected closure date. The Company will intimate the same to the LENDER as soon as it becomes aware of it.

      • For subscription-based payment models, the early termination charges are calculated based on the minimum Rental Duration, which is the least number of months the LENDER is offering a product. The charges will be listed on the product page.

      • The difference in monthly rental rates between the Contract Tenure (the tenure selected at order placement) and the Actual Tenure (effective tenure at early closure) will have to be paid.

    • The amount due will be calculated as follows:

      • (Actual Tenure Rent – Contract Tenure Rent) * Number of Months of Actual Tenure - transaction fee(if any) - commission(if any).

      • Example 1: Suppose a RENTER terminates their order after 7 months. The contract tenure rent is Rs 359 (9 months) but the actual tenure rate is Rs 389 (6 months)

      • Early closure charges:

      • (389-359)* 7= Rs 210 - transaction fee(if any) - commission(if any)

      • Example 2: Suppose a RENTER terminates their order after 1 month. The contract tenure rent is Rs 1019 (12 months) but the actual tenure rate is Rs 1419 (3 months, i.e. the minimum rental duration of that particular product)

      • Early closure charges:

      • (1419-1019)1 + 14192 = Rs 3238 - transaction fee(if any) - commission(if any)

      • Example 3: Suppose a RENTER terminates their order after 3 months. The contract tenure is Rs 499 (9 months) and the actual tenure rate is Rs 499(9 months, i.e. the minimum rental duration of that particular product)

      • Early closure charges:

      • (499*6) = Rs 2994 - transaction fee(if any) - commission(if any)

      • The transaction and commission fees are the reduced from the early closure charges and transferred to the LENDER.

      Note: All offers and discounts given to the RENTER shall be void in case of early termination or part return of items before the agreed-upon minimum rental duration.

  • Force Majeure

    • Company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
  • Dispute

    • All statements, conditions, stipulations and declarations made in the Terms and Conditions will be construed and interpreted in terms of law prevailing in India. In case of any dispute, the courts of Mumbai will have the exclusive jurisdiction to deal with the same. If any clause of the Terms and Conditions is or becomes illegal, invalid or unenforceable under the laws prevailing in India, the clause shall be deemed to be severed from the Terms and Conditions and the remaining clauses will continue to be operative.
  • Entire Agreement

    • This Agreement constitutes the entire agreement between the applicable LENDER/S and the RENTER. The acceptance of this Agreement also signifies the acceptance of the LENDER, to the terms and conditions on the Company’s website. In the event of any conflict between the terms and conditions on the Company’s website (including privacy policy) and this Agreement, the terms and conditions on the Company website shall supersede. The Company reserves the right to amend the terms and conditions of this Agreement and on the website from time to time, the LENDER is requested to check the website for updates of terms and conditions.
  • Limitation of liabilitie

    • neither the company nor its officers shall be held liable to you for any indirect, punitive, special, incidental or consequential damages or losses of any kind, whether arising in contract, tort, equity, or breach of statutory duty. the company and its officers shall not be held liable for any loss, or damage incurred by any user or another person, including without limitation, arising out of or associated with the use or inability to use the website, any listings, user conduct or user content, even if the company was previously advised of the possibility of such damages.

    • the company assumes no responsibility or liability for:

    • any damage or loss of any nature whatsoever, resulting from your access to or use of the website; any interruption or cessation of transmission to or from the website; any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the website by any third-party; and any loss or damage incurred as a result of your reliance

    • upon any information made available through our website.

    • in no event shall the company’s aggregate liability exceed the greater of current market value of the used product

  • DISCLAIMER

    • The LENDER acknowledges their understanding of the terms of doing business with Company and agrees to abide by these terms at all times.
